Step-by-Step Process for Online Trademark Registration
1. Trademark Search
Before filing, conduct a comprehensive trademark search on the IPR site to ensure your desired mark is not already registered or pending.
2. Class Selection
Trademarks are categorized into 45 classes under the NICE Classification system:
- Classes 1–34: Goods
- Classes 35–45: Services
For example:
- Class 25: Clothing
- Class 35: Advertising and business management
- Class 42: Software services
3. Preparation of Documents
Gather the required documents (detailed below) and prepare a clear representation of the trademark/logo in JPEG format.
4. Filing the Application (Form TM-A)
You can file the application online
Class II or III Digital Signature Certificate (DSC) is required for authentication.
5. Examination by the Registrar
The Registrar examines the application for:
- Formalities check
- Distinctiveness
- Conflicts with existing marks
If objections arise, an Examination Report is issued. The applicant must respond within 30 days.
6. Publication in Trademark Journal
If accepted, the trademark is published in the Trademark Journal for public opposition. If no opposition is filed within 4 months, the application proceeds to registration.
7. Registration Certificate
Upon successful completion, the Registrar issues a Trademark Registration Certificate, granting protection for 10 years, renewable indefinitely.
